Overview
Several states have considered affiliate tax legislation that would adversely affect our industry. We at PartnerCentric feel it is imperative that
everyone in the industry - affiliates, merchants and agencies - do everything they can to stay informed and get involved as this is something that
affects us all.
The battle began in 2008 when New York became the first state to introduce such a tax, the so-called Amazon tax. The struggle goes on as other states
now consider laws of their own.
NY Amazon Tax Under Appeal
Amazon has mounted an appeal against the so-called Amazon affiliate tax that became law in New York in 2007. The Performance Marketing Alliance, our industry's new watchdog and advocacy group, has filed an amicus brief in support of Amazon's appeal and is working vigorously to roll back this law, which the Tax Foundation has just declared unconstitutional and unwise. Affiliate tax laws have been passed in the following states:
- New York (April 2008)
- Rhode Island (June 2009)
- North Carolina (Aug. 2009)
The following states defeated affiliate tax legislation:
- California
- Connecticut
- Hawaii
- Maryland
- Minnesota
- Tennessee
The following states considered affiliate tax legislation but the plans never materialized:
- Florida
- Illinois
- Virginia
- Wisconsin
