Advertising tax being considered in Connecticut

Our friends at the Performance Marketing Association, of which PartnerCentric is a charter member, has just announced that the state of Connecticut has renewed interest in passing the advertising tax. We join them in calling for all Connecticut affiliate marketers to add their support to the PMA, which is mounting a challenge to the potential legislation. Advertising Tax update: Time to be heard, Maryland!

The advertising tax debate has come to Maryland, and it’s time for affiliate marketers to get involved by joining the Maryland Google Group.The Senate Budget and Taxation Committee will hear SB 824 at 1:15 p.m. on Wednesday, March 17. If the bill passes, the Performance Marketing Association estimates that more than 100 advertisers will terminate their affiliate program relationships with Maryland publishers.
It is critical to the cause that Maryland affiliates add their voices to this important debate. The PMA will be coordinating a targeted grassroots campaign and needs help from all Maryland affiliate marketers. Please register today with the Performance Marketing Association.

Illinois now pursuing affiliate nexus legislation
Posted on February 11th, 2010 10 commentsJust when you thought it was safe to enter the statehouse, it appears that Illinois is picking up its own version of an advertising tax. The Performance Marketing Association reported today that they’ve just learned about proposed legislation in the state that targets out-of-state merchants using affiliates to establish nexus.
The bill is called SB 3353 and was introduced on the February 10, 2010 by Sen. Jeffrey M. Schoenberg.

Public outcry topples Colorado Advertising Tax
Posted on February 8th, 2010 6 commentsIn a stunning victory for our industry, Colorado lawmakers today announced the removal of any mention of affiliates in a bill that once sought to establish nexus for affiliates in the state.
The Performance Marketing Alliance, the performance marketing watchdog group that is coordinating the offensive against such legislation nationwide, attributes this unexpected news to the large number of Colorado citizens who turned out en masse Thursday night to express their displeasure about HB 1193.
HB1193 is now solely focused on collecting use tax and no longer has anything do with affiliates.
This is not the amendment that has been under development, creating partial exemption for online affiliates.For more information visit the Performance Marketing Alliance.

Update: More states considering advertising tax
Posted on December 30th, 2009 11 commentsSeveral states are considering an advertising tax that would have devastating effects on the affiliate marketing industry, including Alabama, Colorado, Connecticut, Hawaii, Maryland, Minnesota and Tennessee.
Although each state is drafting its own language and terms, this legislation all has one common thread in their attempt to define their resident affiliates as having a sales presence or “nexus” for out of state merchants in order to collect sales tax for purchases made within that state.
